Meal and Rest Break Compliance

The requirements for meal and rest breaks differ across states. We evaluate meal and rest break compliance from several angles: the organizational structure, company policies and procedures, timecard reports, company audit procedures, the history of complaints, and responses to potential violations, among others. We use several methodologies to conduct our investigations: interviews or focus groups with incumbents and their supervisors and managers, reviews of company documents and records, observations of job incumbents, and analyses of payroll records and timesheets. Following our review, we make recommendations to clients regarding changes in the organization and work processes to ensure compliance with meal and rest break laws.

We also develop scientifically-sound employee experience surveys which ask hourly employees about a variety of job aspects, one of those being their experience with meal and rest breaks. We examine the extent to which they are offered and take their breaks, and the extent to which they are prevented from taking their breaks. We also examine reasons why they do not take their breaks, if applicable.
