Case Details


This gender discrimination case involved female farm workers who worked for a grower on a seasonal basis in California. Since the inception of the company, no female had ever been advanced to the position of Crew Foreman on a permanent basis. We were retained by plaintiff’s counsel to evaluate the selection process for the Crew Foreman position and to evaluate whether the selection process was fair and unbiased towards females.

  • Analyzed company documents describing the work of farm workers and Crew Foremen.
  • Reviewed documents and testimony that provided information about selection criteria.
  • Reviewed declarations and depositions of key persons who would shed light on how the selection process was conducted and female applicants’ experience with the process.

Results


Drawing upon her extensive experience in valid selection and promotion procedures and evidence gathered in this case, Dr. Banks wrote a declaration showing that Crew Foreman selection criteria were variable and arbitrary. Dr. Banks further showed that the selection process was such that females did not have the same opportunity to be identified as a Crew Foreman candidate even though they were equally or more qualified compared to their male counterparts. Following the filing of the declaration, the two parties settled.
