Our wage and hour litigation support work began in 1997 when Dr. Banks developed a self-report questionnaire methodology for measuring the time employees spent performing exempt and non-exempt work in their job. Dr. Banks adapted well-established job analysis methods to the new context of misclassification cases, yielding a scientifically sound methodology for collecting the data needed for resolution of these cases. Shortly thereafter, she developed the time and motion observation study methodology to capture real time data on the amount of time spent on exempt and non-exempt tasks on the job. Other methodologies followed including structured deposition inquiry, declaration interviews and work experience surveys.
Our expertise in wage and hour litigation has expanded to include meal and rest break compliance, donning and doffing time, off-the-clock work, tip-pooling, and labor scheduling models and staffing. In addition, our expertise extends to employment discrimination issues involving age, gender, sex and disability discrimination. To date, our studies have been used in more than 80 class action cases in the U.S. and Canada. We use our extensive experience to help our clients find the best solutions for their employment law compliance and litigation support needs.
